MOJ pledges to make the divorce process simpler
The Lord Chancellor, Lord Chief Justice, and the Senior President of Tribunals have issued a joint statement on their shared vision for the future of Her Majesty’s Courts & Tribunal Service entitled “Transforming Our Justice System”.
The report has two key themes: process simplification and digitisation. With regard to Family Law, Divorce is highlighted as a key area to implement these themes. “For those people who decide to divorce, the process will be simpler. The majority of these cases involve a very straightforward court process. Only around 2% of cases are contested. Yet the rules and forms are long and complex and have changed little since the 1970s. We will simplify the process and put as much as possible of it online”.
Despite the desire of the MOJ to simplify and speed up the delivery of justice, the value of an experienced mediator or divorce solicitor when going through the human and financial complexities of a family split is unlikely to be significantly diminished going forward.
