We understand that the costs of being a party to a dispute such as this can feel daunting. We offer several funding options. The right option will depend on the issues in dispute, the value of the claim and the risk involved.

We outline the common types of funding below:

Private Funding – Time Spent Basis

We will bill on a regular (usually monthly) basis for the time which we spend on a matter. Our time will be charged at set hourly rates.

Fixed Fees

For certain types of early investigatory work, we can offer a fixed, upfront fee covering a clearly defined scope.

Deferred Fee Arrangements

In suitable cases, we may agree to defer our fees until a specific stage – usually settlement or final resolution.

You will receive ongoing cost updates, but payment is not required until that agreed point.

Please note that our fees would be subject to an uplift to reflect the delay in payment.

You will remain responsible for other fees and expenses. You may also be liable for the other side’s costs if court proceedings are issued, and you are unsuccessful.

This option can be particularly appropriate if you are guaranteed to have an interest in an estate but have a claim by which this would be increased or if you need assistance to unlock/safeguard your entitlement.

Conditional Fee Arrangements (CFAs)

A CFA—sometimes called a “No Win, No Fee” agreement—is a way of funding your case where our legal fees depend on the outcome.

If you are successful, then you would pay our basic costs together with an additional success-related charge known as a “success fee”.

If you are unsuccessful, then you would not need to pay anything for our costs.

A “successful” outcome includes reaching a negotiated settlement or achieving a favourable court decision. We will define exactly what this means for your claim before the CFA is signed.

Even with a CFA, there are some costs you will remain responsible for, including:

  • Disbursements such as court fees, expert reports or mediator charges
  • Any part of your costs which the opponent is not ordered to repay
  • The opponent’s costs if court proceedings have started and you lose (please note that there may be insurance available for this).
