Negotiating for you

Commercial contract disputes arise when one or more parties fail to uphold their contractual obligations, leading to disagreements over terms, performance, or breaches for example. Common issues at dispute include non-payment, misrepresentation, defective goods or services, and termination clauses. Should a contractual dispute arise, you are strongly advised to seek legal advice to carefully review the contested agreement to mitigate risks and protect your interests.

Resolving contract disputes can take different forms, including negotiation, mediation, arbitration, or litigation. In many instances some form of alternative dispute resolution (ADR) may be preferable, to avoid the costs and time associated with court proceedings. However, when ADR is not feasible or fails, our team can advise and support you through the litigation process in the courts to enforce your contractual rights.

Of course, to minimise the risk of disputes, businesses should ensure their contracts are clear, comprehensive, up to date and legally sound. Well-drafted agreements with defined terms, dispute resolution clauses, and robust legal protections can help prevent misunderstandings and provide a framework for resolving conflicts. Our Commercial Law team can assist you with reviewing historical contracts and drafting new commercial contracts as required.
