Q. What does Lasting Power of Attorney mean?
A. Sadly, there may come a time when you are unable to handle your property and financial affairs or personal welfare. You can officially appoint a friend, family member or professional to hold a lasting power of attorney that will allow them to act on your behalf, if this becomes the case.
You can make 2 different types of lasting power of attorney:
• Property and affairs - allows you to choose someone to make decisions about how to spend your money and manage your property and affairs
• Personal welfare - allows you to choose a person to make decisions about your healthcare and welfare.
These decisions can only be taken on your behalf when the lasting power of attorney is registered.
The Lasting Power of Attorney replaces the old Enduring Power of Attorney, if you have made an Enduring Power of Attorney this is still valid.
Q. How many people should I appoint as power of attorney?
A. It is a good idea to appoint more than one person to help prevent abuse of the responsibility. You should choose people you can trust to act in your best interests.
Q. When does my LPA have to be registered?
The LPA can be registered anytime after it has been signed by all those parties required to sign it. It is often a good idea to register the LPA after it has been signed so that it is ready to use. Either you or your attorneys can apply to register the LPA.
Q. Can someone object to the registration?
A. Only the donor, attorney or named person can object to the registration of a LPA.
Q. I have difficulty walking and cannot come to your offices
A. We offer a home visit service where we can come to your home and talk to you about the options available. We will prepare all documents and send them to your home for you to sign. Often we find that people suddenly become ill and then realise they don't have a will and so we are available to visit hospital and care homes to give you peace of mind.
