Q. I have recently been diagnosed with cancer, despite visiting my GP four times in 6 months to show him the lump. Can I sue for negligence?
A. Yes you may be able to if you can obtain expert medical evidence to support your claim which confirms that a reasonably competent GP should have referred you for tests sooner than he or she actually did and that if you had been diagnosed earlier the outcome would have been better.
Q. Our mother contacted MRSA whilst in hospital for a hip operation and passed away. What can we do?
A. You may be able to bring a claim against the Trust. The damages awarded would cover the pain and suffering experienced by your mother prior to her death over and above the suffering she would have experienced anyway, together with the costs of the funeral expenses. In addition a statutory bereavement award of £11,800 can be claimed by a spouse, civil partner or the parents of an unmarried minor. This figure is less for deaths prior to 1st January 2008.
