If you own a flat with a short lease, it may affect your ability to sell your property in the future. However, you may qualify for a statutory lease extension and we can advise you on the best options available for your situation. Our leasehold specialist can also provide expert advice on collective enfranchisement whereby you and your neighbours may qualify to buy the freehold of your building from your landlord.
Under the rules for collective enfranchisement and leasehold enfranchisement, tenants of a block of flats can compel their landlord to sell the freehold interest to them. In addition, each individual tenant has the right to acquire a 90 year lease extension. The legislation sets out a formal procedure which must be followed in each case. There are certain exceptions, however, and the legislation is complicated.
We advise both landlords and tenants (commercial and residential) on their respective rights under the legislation. We advise companies, individuals and groups of individuals throughout the UK. Although we are based in South East London we can advise and act for you regardless of your location. We provide a nationwide service as these legal processes require specialist advice which may be difficult to find in certain areas of the country. It is not necessary for you or your property to be local to us as many clients now prefer to be contacted electronically or by telephone. We are able to put you in touch with a surveyor in your area if you wish and instruct him/her for you - location is not an issue.
Leaseholders can only enfranchise if both they and their building qualify. Put simply, the building must contain two or more flats and at least two thirds of those flats must be held on long leases. At least 50% of leaseholders must participate in the enfranchisement. It is therefore now possible to improve the value of your flat, and even take control of the management of the whole building.
If you own a flat and it has less than 70 years to run on its lease, then it will be difficult to sell as most banks will not lend to potential buyers on a short lease. It is therefore important to note, before you reach this stage, as soon as the number of years left on your lease drops below 80, the cost of extending it will start to rise more steeply.
