Q. My dad changed his Will and left everything to my brother. Can I contest the Will?
A. In general terms the Will can be challenged if the person making the Will was believed not to have the mental capacity at the time that the Will was made or alternatively if there was an element of coercion or if it would have been reasonable for provision for you to have been made.

Q. I lived with my partner for a number of years but he died without making a Will and now his family say all of the house and his savings will go to them and that I must now move out. Is that correct and do I have any rights?
A. We would need to consider the basis upon which any property was purchased or contributed to and this will turn upon the facts of matters of each case. You may also be able to bring a claim under the Inheritance (Provision for Family Independence) Act 1975 upon the basis that the disposition of the estate does not make reasonable financial provision for you.
