Q. My neighbour is proposing to carry out building work to their property which I believe will encroach upon my land. What do I do?
A. It is important in boundary disputes to determine the evidence available in respect of the boundary both physically by way of a Surveyor's Report and also from an examination of the legal title. Other sources of evidence such as Ordnance Survey Plans will also be useful. Once the evidence has been considered, and if appropriate, an application can be made to the Court to seek an injunction restraining your neighbour from carrying out work until the boundary has been resolved and also at the same time seeking a declaration from the Court as to the location of the boundary.
