Q. When will a dismissal be fair?
A. For a dismissal to be fair, the employer must have a potentially fair reason for the dismissal and the employer must have acted reasonably in treating that reason as sufficient to justify dismissing the employee.
The potentially fair reasons for dismissal are:
• Conduct
• Capability of qualifications
• Redundancy
• Statutory restriction
• Retirement*
• Some other substantial reason
*The retirement ground is currently being appealed and has finally reached the European Court of Justice. A decision is due later this year.
