Q. My 10 year lease is coming to an end for our office premises and our landlord has just served a Notice to end our tenancy. Can the landlord obtain possession of the premises? Do I have the right to ask for a new lease?
A. If your lease falls within the scheme of statutory protection then your landlord can only obtain possession of the certain grounds. If the landlord cannot make out such grounds then you are entitled to a new lease.
Q. We are moving our business premises to take up larger premises but our current landlord is now claiming a large sum of money from us for dilapidations at the end of the lease. Is he entitled to do so?
A. Most leases will contain obligations on the tenant to keep the premises in good and tenantable repair and will set out the obligations at the expiry of the term. A Surveyor's expert evidence is usually required but there are statutory limitations on what the landlord can claim.
